An employment agreement is not included in the Indian contract of labour. In India, however, it is legal as long as the employee is not subjected to unreasonable limitations. An agreement in restriction of commerce is only invalid to the degree that it prevents trade, according to Section 27 of the Indian Contracts Act. As a result, there is no absolute restriction; instead, it only applies to partial restrictions. For the duration of the job, the employer has exclusive access to the employee's services.
